Negotiation is a discussion of issues in an effort to reach an agreement. Negotiation can take place in a lawyer’s office, over the kitchen table or in a café. You might negotiate an agreement yourselves, or your lawyers may talk or write one another to reach a settlement. You and your lawyers may meet.
Essential to succeeding in negotiation is for the process to be fair and to feel fair. Both parties need to make full financial disclosure, and refrain from disposing of assets or taking advantage of the other party.
